MIC leader cries foul over branch deregistration

Lian Seng Garden MIC brach chief R Thayakugan has alleged that Petaling Jaya Utara division coordinator, V Subramaniam of having a hand in the fiasco.
PETALING JAYA: A MIC leader today cried foul over the party leadership’s move to deregister his branch on June 20, saying the decision goes against the party constitution.
Lian Seng Garden MIC branch chairman R Thayakugan said that it was impossible for his branch to be defunct when the party headquarters had accepted his membership quota fees for this year.
“Till today, my branch still receives letters and funds from the party headquarters. We would not be receiving correspondence from the headquarters if my branch is defunct.
“Even if my branch is defunct for whatever reason, the MIC constitution does not prohibit the revival of any deregistered branches,” he said.
Apart from his branch, Thayakugan claimed that the Damansara Jaya and People’s Park MIC branches in Selangor were also deregistered.
He accused the then Petaling Jaya Utara MIC coordinator, V Subramaniam of having a hand in the fiasco, claiming the latter had failed to issue the B Form, which is required before a branch could hold its annual general meeting (AGM).
“Subramaniam refused to issue B forms, alleging some of us branch leaders had attended a meeting with SS2 Tengah MIC branch chairman S Padnmanagan, in February last year,” he claimed.
Padnmanagan is the branch leader who had lodged report with the Registrar of Societies (ROS) on May 20 this year against the MIC leadership, on discrepancies concerning the B form.
Thayakugan argued that the all three branches were allowed to hold their revival meetings in March, leading up to the general election.
“We did our part for the elections, but still were not given the B forms. Instead, Subramaniam insisted for an apology letter for allegedly attending the meeting with Padnmanagan before issuing the B form.
“This is unfair. The MIC constitution even allows absenteeism of three meetings without explanation. Subramaniam’s conditions runs ultra vires to the party constitution,” said Thayakugan.
On his next course of action, Thayakugan said he had issued a letter on July 1 to MIC secretary-general A Sakthivel and the central working committee to resolve the confusion within seven days.
“Failing which, I will refer the matter to the ROS on Monday,” he said.
Thayakugan also urged the party leadership to publish names of all MIC branches, for easier reference on which are the ones still running or otherwise.
“MIC has 3, 998 branches nationwide. Publish their names so that the branch leaders will be able to verify if their branch is still valid, defunct and if it listed with the ROS records,” he said.
Making a mockery
Meanwhile, Subramaniam, when contacted lashed out at Thayakugan asking him not to make a mockery of the MIC constitution.
“He is making a joke of the MIC constitution, he doesn’t know what he is talking about in the first place,” he said.
“The constitution says that you are allowed to be absent for three consecutive meetings, this wholly refers to division meetings,” he added.
Subramaniam, also know as Barat Maniam, said that he called for two meetings only to issue B forms to branches that wanted to hold their AGM.
“I did not call for a division meeting, the meetings were only to issue B forms. I even gave those who couldn’t make it for the first meeting a second chance,” he said.
“Still you don’t show up to collect the B forms, who’s fault is that? If you can’t  make it even for the second meeting, I would have gladly given it to a representative from your branch,” he added.
By not paying heed to the calls to collect the B forms, Subramaniam said those branch chairmen were only disrespecting MIC.
“They did not disrespect me, I was only assigned to issue the B forms. They are disrespecting MIC altogether.”
