Aug 10 fixed for Lingam's judicial challenge over disbarment



The hearing of former senior lawyer VK Lingam's judicial challenge over the decision to disbar him from practice has been postponed to August 10. 
Malaysian Bar representative Razlan Hadri Zulkifli said this is because Lingam's lawyer R Thayalan was unwell today, when the case came up at the Kuala Lumpur High Court before Justice Kamaludin Md Said.
This, Razlan added, was the second time the hearing has been put off. 
Besides Razlan, the other lawyers who appeared for the Malaysian Bar were James Khong and Fahri Azzat. 
Lingam was was banned from practising law two years ago, by the Advocates and Solicitors Disciplinary Board, after he was caught on tape in a judge-fixing scandal, some 10 years ago. 
Lingam filed an originating motion against the Malaysian Bar Council last Dec 15, 2015, to challenge the disciplinary board's decision. 

Lingam through his sister, Kanahalashmi, in a supporting affidavit claimed the report to the board cannot be sustained in law and facts, and hence it cannot be affirmed by the Advocates and Solicitors Disciplinary Board. 
He further claimed the committee had not addressed the standard of proof to be applied on the charge of misconduct, that it is beyond reasonable doubt, and the committee had failed to apply this standard of proof when arriving at its finding.
The former senior lawyer also alleged that the disciplinary committee had made no finding on the charge of misconduct against him, over whether he had interfered or influenced judicial appointments.- Mkini
